INFORMATION FOR CUSTOMER AND IN ACCORDANCE WITH EUROPEAN REGULATION 2016/679

Dear Customer,

In compliance with EU Regulation 2016/679 concerning the protection of natural persons with regard to the processing of personal data, as well as the free movement of such data, the Data Controllers are required to provide Clients (hereinafter referred to as “data subjects”) with certain information regarding the use of personal data.

Pursuant to Article 26 of European Regulation 2016/679, Digital Solution Srl, following an internal agreement, acknowledges and presents itself as joint controller of the processed data, in light of shared means and purposes of processing.

According to the aforementioned regulation, such processing will be carried out in accordance with the principles of fairness, lawfulness, transparency, and protection of your privacy and your right to personal data protection.

Pursuant to Article 13 of European Regulation 2016/679, we therefore provide you with the following information:

 

1) Purpose of data processing

Personal data are processed within the scope of the normal professional, managerial, and promotional activities of the above-mentioned Joint Controllers for the following purposes:

a) Purposes strictly connected and instrumental to the management of the professional relationship, such as:

• All activities related and instrumental to the proper management and fulfillment of tax and accounting obligations; management and execution of contracts; administration and payment management.

• Sending of informative documentation or documentation related to the above-mentioned commercial and administrative practices.

• Compliance with EU and national regulations (Ministerial Decree 3.2.2006 No. 143 Anti-Money Laundering).

• Communication of the data subject’s information to natural and/or legal persons (construction companies, firms, suppliers, subcontractors) necessary for the entrusted assignment, such as: management of variations, choice of finishes and systems, customization of the apartment, etc., as provided for in the specifications.
  The Controllers undertake to provide accurate communication of the suppliers to whom only the personal and contact details of the data subject have been disclosed.

• Communication of the data subject’s information to natural and/or legal persons operating in related activities necessary for the entrusted assignment (such as land registry searches) and/or for the purpose of stipulating insurance policies covering risks related to the entrusted operation.

b) Purposes functional to the activities of the above-mentioned Joint Controllers, such as:

• Processing of data for promotional, commercial, administrative practices and/or arising from legal obligations.

• Information on initiatives promoted by the Controllers.

• Information, through periodic press reviews, on the real estate market trends and the real estate sector in general.

• Promotion of services and/or products offered by the Controllers.

 

2) Personal data and sources

The data subject to processing are provided in accordance with this notice; they are collected at our office through interviews or via data collection forms on our website. Such data may be correlated in order to obtain further profiled information for internal statistical purposes. No personal data from publicly accessible sources will be processed.

 

3) Methods of data processing

Personal data are processed within the scope of the normal professional, managerial, and promotional activities of the Controllers in relation to the above-mentioned purposes, using manual, IT, and telematic tools with logics strictly related to the purposes themselves and, in any case, in such a way as to guarantee the security and confidentiality of the data.

In particular, processing will be carried out using paper tools, automated logics, and CRM-type management software that will allow optimal management of contractual obligations; data will also be stored and processed on a platform owned by Digital Solutions Srl, accessible to the user via username and password, which allows the sharing of information and documents between client and seller. With regard to personal data processed for marketing purposes, processing will be carried out using automated software for sending commercial information.

 

4) Provision and refusal to provide data

The provision of common and identifying personal data for the purposes referred to in point 1 a) is strictly necessary for the performance of the professional assignment.

Each Client has the right to refuse consent for the subsequent points without compromising the main service in question. In such case, the Controllers will not be able to communicate such data to other parties, nor disseminate them.

 

5) Data communication

Without prejudice to communications made in compliance with legal obligations, data may be communicated, exclusively for the purposes indicated in point 1 a), in Italy or abroad, to the following categories of collaborators or external parties:

• Real estate agents (including companies) identified by the Controllers to collaborate in carrying out the assignment entrusted by the data subject.

• Banks and/or credit and financial institutions and/or other agents operating in the credit sector.

• Companies and/or professionals providing services for technical / cadastral / building / urban planning practices.

• Notaries for the preparation of notarial deeds and/or related activities pertaining to the assignment entrusted to the Controllers.

• Insurance companies for the stipulation of policies related to the assignment entrusted to the Controllers.

• Independent collaborators of our company, whose collaboration is necessary to complete and fulfill the service in question.

• Professionals and consultants, whose collaboration is necessary to complete and fulfill the service in question.

• Anyone who is a legitimate recipient of communication for the above-mentioned purposes referred to in point 1 a).

Any other purpose of processing will be subject to your specific consent and will not otherwise be carried out.

 

6) Data retention period

Data will be processed for the entire duration of the contractual relationships established, after which retention will be limited to the data necessary for the fulfillment of all legal obligations. Data processed for the purposes referred to in point 1 b) will be retained for the entire loyalty period. In case of inactivity of the data subject for 5 years, contact data will be deleted in January of the sixth year from the last recorded interaction.

 

7) Profiling

The data provided may be subject to an automated profiling process aimed at producing statistics to improve our service and our offers. Digital Solution Srl, in order to proceed with profiling your data, requests your explicit consent.

 

8) Transfer of data abroad

Personal data may be transferred to EU countries and to non-EU countries within the purposes indicated in point 1, but only after verifying the existence of an adequacy decision by the Commission or based on standard contractual clauses as provided for by Article 46 of the Regulation.

 

9) Data Protection Officer

The Controller has appointed a Data Protection Officer who can be contacted for any information or request at the email address info@dsdigitalteam.com.

 

10) Rights under Articles 15 to 22

Articles 15 to 22 of the aforementioned Regulation grant the data subject rights regarding access to their data, deletion, rectification, revocation, restriction, and portability of their data.

In particular, the data subject may obtain confirmation of the existence or non-existence of their personal data and request that such data be made available in an intelligible form.

The data subject may also request to know the origin of the data as well as the logic and purposes on which the processing is based; to obtain deletion, anonymization, or blocking of data processed in violation of the law, as well as updating, rectification, or, if of interest, integration of the data; to object, for legitimate reasons, to their processing.

Consent details

1. Purposes strictly connected and instrumental to the management of the professional relationship, as reported in point 1 a) of the notice. Consent to this item is strictly necessary for the performance of the professional assignment.

2. Data processing aimed at providing information, through periodic press reviews, on real estate market trends and the real estate sector in general promoted by the Controller, carried out both through automated means (such as emails or operator-free calls) and traditional means (such as postal mail), thereby authorizing receipt of such documentation produced by the Controller.

3. Profiling of collected data in order to produce internal statistics aimed at improving our services and offers or conducting market research.
